1 owner deceased need to change title of house

Posted on: 07th Jun, 2010 10:24 am
My father who lived in New Mexico was on the title along with my mother of a home in North Carolina. This home is supposed to be left to my cousin. There is a will and are going through probate in New mexico. Would we need to file probate in North Carolina? How do we simply do a name change?
Hi camille!

Welcome to forums!

As the property is located in North Carolina, the will should be probated and filed there. Unless you probate the will, the property cannot get transferred in your cousin's name.

Feel free to ask if you've further queries.
