Widow w/ house & no deed

My husband and I shared a home that we paid off. However, my name was never put on the deed. He passed 1.5 years ago and have been stuck in legal limbo since. There is no problem w/ the house being my property - the problem is getting the deed from the mortgage company. The lawyer is FINALLY taking the company to court to try to get them to produce a deed. I have had a few people asking about purchasing my home. Is there a way I can sell the home before getting the deed in my hand. I'm afraid it's going to take forever to get the deed & I don't want the property sitting empty any longer. Any advice would be appreciated! Thank you.

I am really sorry to hear about your husband's death.

Few things I did like to know from you, did your husband make any will naming you as the person to get the property after his death? You are saying the there is no problem with the house being your property, can you give more details about it. Like what your husband has done to make sure that you get the house after his death.

For selling the home you need to have your name on the deed as until then you are not the legal owner of the home and cannot sell it.

You should ask the lender to provide you with a certificate of satisfaction to get a release of mortgage lien from property records. After you get it from your lender which must be signed by him, get it notarized and recorded with the land records office.
