looking for the definition of a clouded deed? How is it done? Is it enforceable?
Hi scurrier!
Welcome to forums!
A clouded deed is an actual outstanding claim on the title to real property. "Clouds" include old mortgage on the property with no recording showing that the debt was paid off. It may also refer to a failure to properly transfer all interests in the real property to a former owner or a previous deed which was not correctly written or signed. A "cloud" on the title of the property can be removed by a quiet title action.
Feel free to ask if you've further queries.
