my father just died. He had a home in His name. His will states his home is to be devided into 1/3rds for the surviving children. My brother is quite in debt. Can the collection agency put a lien on the home because his name will then be on the deed? What if my brother wanted to sign his 1/3rd over to me and/or my sister. Can he do that. There is no morgage on the home.

The collection agency can place a lien on the property as your brother will be one of the owners of the property. As there is no mortgage on the property, I think your brother can sign off his portion of the property to you.
