contesting a ladybird deed

Posted on: 18th Nov, 2010 11:19 am
Hello, hope someone can give me some advice. My mom has been taking care of my great aunt for several years and she recently passed away. My mother was the beneficiary on several things as well as on the will for the house and the contents. Recently, we found out from the attorney who was filing the probate that there was a previous version on file from 2004 of a ladybird deed my great aunt signed to some con man who was not related to the family. He tricked her and I know she didn't know what she was signing as she plainly left the house and everything to my Mom in the last few years. Is there anyway to contest? My mom called an attorney and he said "no", but this is a whole in the wall town in Texas and we aren't sure who to go to now. If we even knew this document was in existence we would have had it changed but it just sucks there are people out there who take advantage of the elderly. Thanks for the help!
Welcome sja,

If the ladybird deed was signed by your great aunt prior to the will, then the ladybird deed will be taken into consideration and that person will be considered as the owner of the property. If that person signs the deed in your mother's favor, then she will be able to claim the property.
