Parent died leaving house to 4 children. One daughter lived in house for many years with no written lease, only a verbal agreement. She paid rent sporadically and paid taxes. Now other owners want to sell and have filed partition action. Question is whether the 3 non-renting owners can collect past-due rent or deduct what should have been paid in rent from proceeds from sale.
Welcome cam,
You have mentioned that the daughter who lived in the property, paid rents sporadically. In that case, the the other 3 non-renting owners should not come after her for the dues or deduct it from the sale proceeds. However, the concerned daughter should contact a real estate attorney and take his opinion in this matter. He will be able to guide her in a better way.
