the mother passed away 6 years ago, her current husband probated the will leaving out nearly 10 properties. In the process the probate judge ordered him to escrow all income from the propery( oil and Gas). Now there is only one child left. She should be able to file intiment of title on these property. The widower has committed fraud and has released all his rights and intrest to avoid prosicution in Texas>

If the mother's will declares the husband to be the sole beneficiary of the properties, then the daughter will not be able to claim any rights to that property. If a fraud has taken place, then the daughter should contact an attorney and take his opinion in this matter.
