Quit Claim Form

My uncle passed in 1994. He had a will leaving everything to me but I cannot find a copy of the will. He had a house that I have been taking care of. I would like to put the house in my name. I was told I could use a quit claim form to make that change. Is that correct?
you cannot transfer ownership of something you do now own to yourself. it behooves you to find that will or some other document that would tie your uncle's wishes to you.

what has been going on since 1994 that prevented you or anyone else in the family from attending to the legal matters of his estate - to include this house? that is the first thing you need to iron out here.

I agree with George that you cannot transfer the ownership to yourself by using a quitclaim deed as you are not the owner of the property? Only an owner can quitclaim his property.

Now I think you should contact with an attorney ASAP and go for a title search.

Hi Riley,

If possible contact your uncle's attorney. You may even give an ad in the newspaper regarding his identity. He'll be able to provide you with a copy of the Will. Now, if that is not possible and if there aren't any other heirs as per your knowledge, then you can file an affidavit of heirship and transfer the property in your name.

You cannot execute a quitclaim deed since the grantor is deceased and cannot sign it. You will need to contact a local probate attorney to go to court and get the title corrected. Typically, one can file an "affidavit of heirship" with the court to get the title corrected.

We had a house in my husbands name hurricane blew house away so we got a trailer in both our namesBut the the property part is still in my deceased husbands name We had no estate &there is no will

I am looking at a property that from what I understand has been vacant for years. The legal owner is deceased and the family is no where around. I tried to get it from the city but since it is still in the deceased man's name they can't release it. Is there a way to get this property transfered to my name.

Unless you can contact the heirs, it will be difficult to get the property transferred in your name. However, you can contact a real estate attorney and take his opinion in this regard.

how do i transfer title of mobile home that was sold in name of deceased person who had no estate and i was the power of attorney. deceased person had no assets at time of death only mobile home which is not considered an asset and has a title like a motor vehicle
