I live in New Jersey. My husband died in November 2009. We purchased our home in 2004. We were told my name would not be on the mortgage because of my credit but would be on the deed. I paid off the mortgage and went to take his name off of the deed and found out that my name is not on the deed but on the mortgage. The mortgage satisfaction paper has my name but not the deed. HOw do I put my name on the deed and take his name off?

Did your husband leave any will in your name? In case he did not, you will have to file an affidavit of heirship with the probate court to get the title in your name and remove your deceased spouse's name from it. Since the mortgage has already been paid off, there should not be any problem for you to get the property deed solely in your name.
