name removal

Posted on: 10th May, 2009 06:40 pm
My father passed away 6 yrs ago. My family recently decided to have his name removed from the family property. Can this be done without the signature of his heirs? I know they signed his name and sold a vehicle but my brothers and sister and I are being left out of a piece of property that was my dad's pride and joy. Theres 15 of us cousins and only the 4 of us are being excluded because our dad had the misfortune to die first.

Upset in Ohio
Hi AimArm,

If your father had left a will, the property would be probated and his name would be removed from the title. If there is no will, an affidavit of heirship will have to be filed with the probate court. The court will then decide how to divide the property among his heirs as per the laws of intestacy.

Hi,
Its very bad that your father had left .
Now you try to remove title of your father name to you & your brother.
But all property has your father name so all your brother & you has share with that property. so try to divide wih you & your brothers as you all convincence.
IF not possible , go to court then court will divide to all of you .

Thanks
Hari
