hi all. my ex fiancee is deceased. he left his 1/2 of our rental income property to his new wife (who had only known him less than a year and married him 3 days prior to him being placed on life support)...anyway...it's been a year since his death. I have a buyer for the income properties...can i have her removed from the deed and sell. Also. Do i owe her his portion of rent payments that i have collected prior to the will being settled?

You will have to ask your ex-fiancé's wife to sign the property deed and transfer it to you. Then you would be able to sell off the property. If you owe your share of the property, then you don't need to pay her any rent.

The new wife is entitled to 1/2 sale proceeds and 1/2 rent collected.
