How can my husband sell his deceased mothers home

My husband's mother passed away 5 yrs ago. She did not leave a will. The home is paid for but he and his only sibling could not find a copy of the deed. They contacted mortgage company at time of her passing and co. had destroyed files because home had been paid for more than 5 years earlier. Tried to contact title company but they went out of business.

Also confusing because their Aunt bought home with their mother. They do have Assignment papers dated 1983 showing Aunt turned over her rights to the mother.

Your husband should contact the county recorder's office in order to get a duplicate copy of the property deed. Once he gets the deed, he and his brother will have to file an affidavit of heirship at the county recorder's office and get the property deed transferred in their names. Then, they can sell off the property.
