declaration of heirship

What happends when someone doesn't want to sign a declaration of heirship in the state of Texas???
My sisters myself and brother are heirs to our grandfathers work (mothers side), he was a composer who copyright all his published and unpublished works. I've been told that a declaration of heirs needs to be filed per heir for publishing company to claim royalties and have ownership of his catalog, etc. Do we use affidavit or declaration? whats the difference and process? Publishing company is out of NY, grand father resided in PR. Any info will be appreciated. Thanks

This is something which your attorney will be able to answer better. But as far as I know, you will have to file an affidavit of declaration. Contact an attorney and take his opinion in this matter.

my husband is illegitmate child, but the legal wife took him and raised him as her own. he is using the name of the legal family.
my husband father has 5 children (including my husband) to the other woman. and another 5 children to the legal wife.
His father is already dead, what are the rights of my husband and his other brother and sister?

Both my parents passed away, my mom died first. we have a DECLARATION OF HEIRSHIP on my dad's name. The bank kept my parents home, sold it and there is money left to be claimed by my 5 brothers and I. The judge is requesting a declaration of heirship on my mom's name. How can we obtain one if mom passed away?

My Husband passed away with no will. I filed an affidavit of heirship with my Attorney. This was finalized in the court this month. Does this mean I have inherited this property? What are the next steps I need to do, so the property will not be taken away from the deceased family?

If the affidavit of heirship was recorded and everything was finalized, then you may now be considered as the owner of the property. Nevertheless, you can still contact a real estate attorney and take his opinion in this regard.
