My husband had 3 children prior to our marriage. He died and my name was not on the deed. The children's mother is trying to get our home. Is she entitled to the house. The husband did not leave a living will.

If your name is not on the title and your deceased husbnd did no leave any will for the property, you should contact a lawyer and file an affidavit of heirship with the probate court. The court will then decide how the property will be divided as per the laws of intestacy.

It will depend upon you and your sons as to how you'll be able to divide the sale proceeds. If your son's name are not mentioned on the property deed, they cannot legally claim the money from the sale proceeds.
