transferring deed and mortgage after death

Posted on: 17th May, 2010 12:46 pm
hi, all -

my sister and i inherited my mother's apartment after her death. some questions, confusion, concerns i hope you can help me with... i am executor of the estate.

1) i understand i have to transfer the deed to our names. i believe there will also be transfer tax fees. do i need an attorney to do this paperwork? or can i get forms and do it myself?

2) we've been paying the mortgage for 9 months. the bank will want a copy of the deed and final distribution deed which i don't have yet. do i need to worry about time frame or about them making sure we qualify for the mortgage or will they just let us continue with it in our names?

we are named in her will as inheriting everything and it seems pretty simple, but maybe there's something i'm not aware of....

THANK YOU!
Joon
Hi Joon!

Welcome to forums!

It is always better to take the help of an attorney in order to get the paperwork done. He will be the best to take care of all the legal issues.

The bank will want the deed and the mortgage to be transferred in your name. If the mortgage is in your name, you do not have to refinance it any further.

Feel free to ask if you've further queries.
