I was divorce in year 2000. At the moment of divorce ex and my name where on the title of the condominium, as husband and wife. In 2001(after divorce), ex signed the deed to himself and me tenants in common. Question: did he by this deed change percentage of our ownership from 50/50 to 75 for me and 25 for him or not. This is a part of very complicated case, modification of divorce decree. I am having an opinion of 4 lawyers and two of them say ownership stayed the same, 50/50, another two say 75/50. thanks eva fox p.s. I would be more than happy to send the scan of the deeds.
I think you will really need to consult an attorney
If the attoneys cannot figure out, I am not sure if any oen else can
Have you asked your Ex exactly what was done?

Hi shipadsouza,
It's not impossible to change the ownership to 75/50. However, a lot depends on what appears on the deed. If the deed specifically mentions the share of ownership as 75/50, then it becomes clear that the share of ownership was changed while the deed was signed in 2001. However, if the deed lists you and your ex just as tenants-in-common, without specifying the share of the ownership, it means you both have equal rights in the property. In that case, your share in the property is 50%.
