Can deed transfer be revoked?

Posted on: 09th Feb, 2010 08:32 am
Life tenant (Mom) signed deed to older daughter. 4 years later she changes her mind and wants to give it to younger daughter and is suing older daughter to sign it back claiming foul in her original intent. How can court decide truth if she won't involve her own elder lawyer who drafted L/E.
Hi Peter,

It's not going to be easy for the mom to reverse the transfer. She was the one who signed the deed to transfer the property to her elder daughter. She cannot easily take the ownership back from her daughter. Moreover, how is she going to prove her elder daughter's ill intent, if her daughter did not force her to sign the deed and if she did not forge her signature?
