I'm in the process of a divorce my soon to be ex husband is going to sign a deed of trust what is this? and If he doesn't pay on the house payment do I get to step and make the payment and remove them for the property

A deed of trust is similar to that of a mortgage transaction, the difference being that here a third party is involved. Is your husband entitled to receive any share of the home? I guess such a transaction won't work if you have already filed for the divorce. That's because he won't be staying in the house any more. according to me if you got divorce and don't want to leave with him so you can sell the house and divided same property price between us or another way for you can get loan for home any other good bank with your friends supports . please take every precautions and concern to advocate .

A deed of trust is a mortgage. It is a security interest in the property. Upon failure of some specified event (usually payment) you can foreclose on the deed.

my husband and i bought a home back in 2000 and my father in law put up his land and done a deed of trust, since then my father in law has past away and he left the land to my husband in his will. can the mortgage campany take our home since the org. deed of trust was in my father in-laws name and not my husband name at the time we bought out home?

If you are paying the monthly installments regularly, then the mortgage company will never take away the home. However, you can ask your husband to file an Affidavit of Heirship in the county recorder's office to transfer the property in his name.
