Legally what is the best route to take?

In 2003, while married I soley purchased a house. In 2006, while still together I sold my house only to find he was entitled to a percentage. Last year we recently got back together only to find we cannot be together, as he hasn't changed. I intent to legally separate and divorce him; however, I would like to purchase another house without experience the aforementioned for me and my kids. My husband has agreed to relinguish all rights. What type of form should I use: warranty deed or quitclaim deed?
I went through a divorce in 97, I let my wife keep the house and signed a quitclaim deed. I believe that will leave you with all the equity along with responsibility for the mortgage. Hope that helps

hi inhistiime,

after you are divorced, then the property that you purchase would be considered as your separate property. your income and credit score will be considered when the lender would give you a loan. as far as the present property is concerned, you can sign a quitclaim deed in your husband's name and transfer it to him. then he can refinance the property in his name.
