I need to sell my house and wanted to know if i have to wait to get a divorce before i can do so. Or can i have my soon to be ex sign over the house to me and go ahead and put it on the market? I've been paying on the house myself for 11years. my husband left and i finally have found him to be able to get our divorce. He is willing to sign over the and doesn't expect to get anything from it. and i want to make sure he doesn't. But my urgency is because i need to sell the house because i am behind and don't want it to go into foreclosure. any information you can give me will be greatly appreciated.

You can ask your husband to sign a quit claim deed and transfer the property to you. This can be done before the divorce is complete. Once he does so, you will be able to list the property in the market and sell it off. Once you sell off the property, you will have to pay off the mortgage dues in full.
