Divorce and Mortage Payments

Posted on: 11th Feb, 2010 11:11 am
i was divorced last year and in the divorce papers it says that i am responsible for mortgage payments, etc...however, my name is nowhere on the loan or the title. it was purchased before we were married and is in my ex's name. i have been trying to get it out of her name but she is not cooperating and i do not have the credit just to refinance. can i be held responsible for the monthly notes and taxes?

as a side note, since the house is in her name she has been claiming the taxes, etc on her income taxes even though i have paid them.
Hi Guest!

Welcome to forums!

As the property and the mortgage is in your ex's name, there are less chances that the lender would come after you for the mortgage dues. The lender will ask your ex to pay off the dues. If she can't pay off the loan, then her credit report will be affected.

Feel free to ask if you've further queries.
