my mortgage loan is just in my name. the deed is in my name and my husband's. in the divorce i will be granted full rights to the home. can his name be removed from the deed after the divorce is final without having to refinance the current mortgage, because i would not be able to afford a refinanced mortgage payment, but i can manage if the mortgage is left alone.
Hi Brock,
You can get his name removed from the loan by getting a quit claim deed signed by him whereby he would give up his interest in the property. As your name is already in your name, i don't think you will be required to refinance it.
