New York: Mon wants to transffer ownership of her home to my wife and I. She and another man bought the property as Tenants in Common, they married, they divorced, judge ordered in divorce decree that mom gets home. No quid claim.
We are not using a lawer. I am drawing up the Warrenty Deed.
She is selling as an invidual however her deed clearly states the property is owned by both her and her ex.
Can I just add the Decree as say "exibit A" ?

Your mother will have to ask the other owner of the property to sign a quitclaim deed in her favor. Once the person does so, then she can sign a quitclaim deed in your favor. If there is no mortgage on the property, then she can sign a warranty deed and transfer the property to you.
