How do we remove soon to be ex-wife from a deed that is joint tenancy?

Posted on: 30th Nov, 2008 03:14 pm
My boyfriend and his soon to be ex-wife own property as joint tenants. She moved to another state 11 years ago. My boyfriend owns the property free and clear, no mortages, his wife agreed to sign divorce papers. How do we remove her name from the deed on his house?
Hi jclausgirl

Welcome to forums!

As far as I know, your boyfriend's ex-wife needs to sign a quitclaim deed in your boyfriend's name. This will remove her from the property title and henceforth she will have no rights to the property. Sample quitclaim deed forms are available online but she can even draft it from an attorney. Once she quitclaims the property, the deed should be notarized and recorded at the county recorder's office.

Feel free to ask if you have further queries.
