Getting Divorce is quit claim the best way to go

Posted on: 13th Jun, 2007 09:17 am
I am getting divorced and my husband is getting the house. We have a lein on the house that he will take care of. The mortgage company has said all I have to do to get my name off of the title is to send in the divorce papers and the copy of the deed that says it is his. Would a quit claim take care of the deed so I am no longer on it then I can take my name off of the title.
hi beverly,

welcome to mortgagefit discussion board.

you can use a quit claim deed to take your name off the title of the house. on the deed you will be named as the grantor (who transfers his interest) and your husband as the grantee (who receives ownership).

after the deed is filled, next step is to get it notarized and recorded with county recorder's office. this procedure will complete the title ownership transfer process. you can then contact the mortgage company with this deed and the divorce papers to get your name removed from mortgage papers also.

do let me know if you have any other questions.

thanks
