Enhanced deed

Posted on: 26th Mar, 2009 04:51 pm
My question is when my mother died (2005) , my father did an enhanced deed for myself and my brother (April 2006) , then in (May 2007) he did a contract to sell me the house for $200.000, for which I gave him $35,000.00, and we agreed that I will pay him $600.00 ea. month, than in Oct. (2007) he did a revocation of the deed to removed myself and brother .
Now can he sell me the house and have me in the enhanced deed at the same time.
Now he wan'ts to cancel the contract , and for me to leave the house.
The 3 names still shows in the title of the house.
Can he do that ?

Pls. advise me.

thanks.
Hi

In an enhanced life estate deed, the grantor retains the right to sell the property and also transfer it to whoever he wants to. Thus, I think he can sell the house to you. But I don't think he can cancell the contract at his will. If the contract is legally valid, both parties involved in it must reach a consensus to terminate the contract. I think you should contact a real estate lawyer to get rid of this issue.
