My mother gifted her home/property to me two years ago. A year prior she was diagnosed with Stage IV Colon Cancer and began receiving Medi-Cal/MediCare benefits. The home has been in my name for two years now. Will Estate Recovery still apply?

According to the laws, estate recovery cannot be done if an adult child has lived in the home for at least 2 years just before the deceased Medicaid recipient was hospitalized and has lived continuously since that time and the child can also establish that he or she provided care so that the recipient's admission to the nursing home can be delayed. I think estate recovery will not be claimed in your case. However, it will be better if you could take some legal help.
