How can I get someone off the deed of my house?

my ex fiance and myself bought a house together two years ago. about 6mths later we broke up and he can not be found. i can not refinance or sell my house with out his approval because both of our names are on the deed and the mortgage, but i can not do this becuase i don't know where he is. can i get him off the deed with out his signature and how can i do this
Hi familylovenew,

In case you cannot find him to get a quitclaim deed signed to take him off the deed I think, you can file a quiet title lawsuit in the court. You can also consider the option of getting a title insurance in case he comes back with a claim on the property.

i live in a house that was bought with my husband first wife and he has did a quick claim to me giving me his share of the house but his ex wife name is still on the deed to this house i've been living in for 14 years i need her off the deed.

Hi Carla,

You need to get a quitclaim deed signed by her in order to remove her name from the deed. However if she cannot be traced, you need to file a Quiet title lawsuit in the court so the title is transferred in your name.

MY MOTHER INLAW AND MY HUSBAND AND MYSELF ALL HAVE A HOME TOGETHER ALL THREE OF OUR NAMES ARE ON THE DEED CAN SHE REMOVE US FROM THE DEED AND KICK US OUT EVEN THOUGH SHE USED HER CREDIT

your mother-in-law will not be able to remove you from the property deed. however, if you sign a quit claim deed in her favor, you would lose ownership rights to the property. then she can ask you to leave the property.

My wife and I divorced, no kids. In the separation papers I accepted to receive the house and the car (they were paid already), she got all our money from the bank... she was better off in that way. Now I still has the Dee with our names. The Property Appraisal Office took her name off and left only my name. When I pay the property taxes it is in my name. Now I need to clear her name from the DEE... Please, tell me what should I do. Tks a LOT

Hi Triana,

You should ask your wife to sign a quitclaim deed and transfer the property to you. This will make you the sole owner of the property.

Both our names are on the Mortgage, and he hasn't payed his share in forever. We aren't together anymore, we were never married and I want him gone. Can I kick him out, maybe after a Quitclaim? IL

If the property is in your name solely, then you can ask your partner to leave the property. You can even take legal steps against your partner if the person does not leave the property.

I bought a house back in 08 while happily married mortgage in my name only but my spouse was added on the title. We are separated now and she has signed a separation agreement wanting nothing from the property. How do I get her name off the title?

You can ask her to sign a quitclaim deed and transfer the property to you. This will make you the sole owner of the property.

my sister was add on my father deed. However, my father did not know till later and he want her off. But we cannot find her.. it been over 11month. What can we do because she's not paying her share! can we file something at the court. and send it to her last job? help

Well, unless your sister signs a quitclaim deed and transfers the property to your father, her name will remain mentioned on the property deed. You may contact an attorney and check out if he can let you know any way out.
