we have filed an affidavit of heirship for the property my dad owned at the time of his death. This property is not community property as it was purchased prior to my dads death, however the widow and her children live in the house. Can I use my filed affidavits to evict these people, is the affidavits considered a "deed" so I can show ownership now that it is filed or is there something else I need to do to transfer the existing deeds out of my dads name into mine
Hi msdntexas,
An affidavit of heirship proves that you are the owner of the property now after your father's death. You can use this as a proof of your ownership and ask the widow and her children to leave the property.

I will get right on sending a certified letter to serve as notice to vacate the premises along with posting a notice on their door. This will be a part of my record in the event I end up having to file an actual eviction suit.
