My mother quitclaimed the deed of her house to my husband because she had cancer and we were taking care of her.Come to find out after her death she had a motgage on the property.The question is why didn't the company come foward when she quitclaimed it to him.The title is in my husbands name and the company now is trying to take the house and ask my husband to sign over the title but my husband will not I need to know what to do because they put a for sale sign in our yard.Help!!! :cry:

Surely you can dispute this action in the civil court.Your point is right,when your mother quitclaimed the deed to your husband at that time only the mortgage company should have approached you and should have notified you.
You can raise this issue in the court ..By the way where do you live? I mean in which state? because state laws does have an important role on the verdict of the case....Apart from this I will advice you take a wise consultation from any of the local attorney who is well aware about the state laws.
