 My grandmothers in a nursing home and all her children are ceased. One of the grandkids went to her and had her sign power of attorney. What I want to know is how the paper could be legal when she is in there for altiemers,is the paper legal or not worth the paper its wrote on?Can she she just walk in there and take possession of her home?Do I need to hire an attorney, help?
Hello Reeree,

Was your grandmother in her senses when she was signing the document?

If not, then the power of attorney may not be legal. You may take the doctor's help for this.
But if she can prove that it is legal by signing it before the notary and recording it at the county clerk's office, then it is valid.

What kind of right she has depends on the type of power of attorney she has been given.

If your grandmother has already made a will, then she is legally bound to execute them according to the will. If not, you may also claim the property by an affidavit of heirship.

It is always better to consult an attorney and take his help.

Hi Reeree,

I think you should first consult with an attorney.

Now if you can prove that your grandmother has signed the power of attorney when he was not in her sense, then it will not be counted as valid.

Can you please tell us what kind of power of attorney it is?

Thanks,
Larry
