How to get my husbands name on deed after his grandmother passed away

His grandmother passed away in Nov, the land was left to his dad and aunt. Since then the deed is openand they are waiting on a hospital bill to be paid off. Well, we are buying a home and his family is giving us the land we want, but how do we get it in our or his name what the deed being open?

You have mentioned that the land was left to his dad and aunt. I guess, the property deed mentions the dad and the aunt as the owner of the property. Now, his dad and aunt need to sign a quitclaim deed in favor of your husband and transfer the property to him. Once the deed is filled out, it needs to be notarized and recorded at the county recorder's office.

We are all new to this ... I do not think the deed has his dad or aunt's name on it but I am not 100% sure ... she passed away before they made any changes. My next question is, if their name isn't on the deed is there a way around that, and do we have to wait for the doctor bills to be paid in full? and also what is a quitclaim deed? thanks for all your help!

As you are not sure whether his dad's or aunt's name is on the deed, I would suggest you to check it out first. If his dad's or aunt's name is not on the deed, then the property should be first transferred to them with the help of an affidavit of heirship and then they can transfer it to your husband by a quitclaim deed. In my opinion, you should wait for the doctor's bill to be paid in full and then transfer the property.
