Help! General Warranty or Special Deed

Posted on: 10th Jan, 2009 09:44 pm
Hello,
We are in desperate need of advice regarding property that is/was owned by my mother, who is still living but in failing health. My twin brother had taken her to an attorney without informing either myself or our older brother and had her sign over her property that had been promised to me. She brought my wife and I papers stating this to be the case and they had a date stamp from the courthouse, although it was in a different county. We had an opportunity to work in another state for a non-profit organization and took the opportunity (up to then we had lived on the property and raised our daughter there for 11 years) and we still have a home on the land. 11 days after we moved, the papers had been filed in the courthouse in our county, which is where the property is, but he and his wife are now showing as the owners. There is something fishy about the paperwork. Our paper work says general warranty and the paperwork he filed shows special warranty deed. We think there may be a forged signature and in speaking to my mom on the phone that's not what she signed. Help! who should we call or where do we start to get the ball rolling to clear this mess up! thanks so much...
Hi snsnslc,

Welcome to the forums.

Your mother seems to be seriously ill. I pray for her good health. If she is indeed not able to understand what she's signing, it's wrong to make her sign a deed and then get it filed at the courthouse. If you'd like to take a legal action against your twin brother, you'll have to prove that he has taken advantage of your mother's illness and made her sign it. It's best to consult an attorney for further insight on this issue.

good luck
