I went to probate court last year because my husband died last year with the home only in his name. I provided proof that the property my husband always considered it as community property. The Judge approved my petition/order and requested that I go over to the courts and file the order the same day which I did. I was not aware that the original petition/order was to be filed with the County Recorders office which I did about two months ago. The problem I'm having is that this did not change the property into my name and I need to know how to do such because I'm in the process of having the loan on the house modified and can't move forward until this is done. Can you please tell me how this should be done and forms I need to prepare?
Hi sue!
Welcome to forums!
If your husband did not leave a will, then you can contact the local county recorder's office and file an affidavit of heirship. This will help you in transferring the property in your name.
Feel free to ask if you've further queries.
