afidavit of heirship

Posted on: 23rd Aug, 2010 09:39 am
hello,

my dad had just passed away and had been in joint teneancy with my aunt an uncle with 3 propeties. My dad did not have a will but the properties in question had a will from my grandparents, but was already figured out before. So my question is should my sister and I fill out an affidavit of heirship to take his name off and put or names on?
Hi tommy!

Welcome to forums!

If there was no right of survivorship mentioned in the property deed, then you and your sister will be able to file an affidavit of heirship at the county recorder's office and get the property transferred in your names.

Feel free to ask if you've further queries.
