Affidavit of Heirship

My mother passed away a little over a year ago and before she died she told me that she had a will. I think my step father may have destroyed the will. What can be done about the property that she had and that they shared together?
Hi mareshiar,

You are one of the heirs to the property and you can file an affidavit of heirship in order to claim the property. However, if you get hold of the will, then you will have to probate it. Once the probate is complete, you'll have to record the will at the county recorder's office and get the property transferred in your name.
