Can who kick you out? Did your mother leave a valid will stating you are the heir to the property? Are you on title? If you are on title, and the property was willed to you, then you are the rightful owner, and no one can evict you. If your mother had a will, and there are other heirs, then the property would be divided among the heirs. Also if there was no will, the property would have gone through probate, to see if there are more claims to the property.

You should get the property transferred in your name. If there is no will, then you should file an affidavit of heirship at the county recorder's office and get the property transferred in your name. This will make you the sole owner of the property. After that you can refinance the mortgage in your name. Once the property and the mortgage is transferred in your name and if you keep on paying the mortgage on time, then no one can evict you from the property.

If you keep on making the monthly payments on time, then the lender won't foreclose the property. Did the lender give you any reason as to why you won't be able to take over the loan?
