The house was purchased in both their names (his and my suster's) jointly so they were both on the deed, and when he passed away the mortgage insurance paid off the house, so my sister got title There was no house (my sister and he had not purchased it yet) when he made the will in the early 1980's, so there is no mention of the house in the will. As per my knowledge you sister needs to record the document of heirship in the county recorder's office. Tell her to consult with a good lawyer to get detailed information in regards to the transfer of the property in her name.

Though the sister did not purchase the house, she inherited it. I hope the will has been recorded at the county recorder's office after probate. The property division as mentioned in the will would be taken into consideration while dividing it.
