My mother passed away in 2006, she left her children land, as tenants in common. One sibling wnated to put his wife on with him, an attorney said we all had to do that because it was tenants in common. So all of us did as he instructed. After 2 years my husband is divorceing me and he wants me to buy his share of my inheritance. I don't think that is fair. I never dreamed he would divorce after 46 years. I mean would you. Anyway I am looking for some way to not have to pay him for my inheritance. He is a jerk. We are both 66yrs. old.

If you do not want to have any interest in that property, then you can simply sign a quitclaim deed and transfer your share of the property to him. He cannot force you for buying his share of the property.

if you've not got the matter settle by this post. in texas the only way to avoid having to purchase the husbands interest is to have a judge award it to you in the final decree, you have to ask for it as part of your settlement. Depending on why you are getting divorced, say if he was cheating and you can prove it, you may win the property and it cost you nothing... BUT, more than likely no matter what state you live in, you may have to give something in exchange instead of money... car as example. unfortunatley both lose in this situation no matter who ends up with the property. Sorry this is happening to you
