inter-spousal transfer deed

Posted on: 23rd Feb, 2010 11:58 am
My ex-husband has signed an inter-spousal transfer deed to granted me the property. However, after a few years passed and I need to refi the mortgage but lender won't give me the loan because I still owe my ex money agreed on the divorce settlement agreement. The lender requesting me to pay off the money I owed to my ex first before I can refi.
Is there anyway to work around this because I don't have big chunk of money to pay off the balance I owe to my ex at this time.
Hi Guest!

Welcome to forums!

If you signed an agreement which stated that you would be liable to make payments to your ex-husband after he signs the inter-spousal deed, then the lender may ask you to pay him off first and then let you refinance the loan. You can speak to an attorney and check out whether or not you can workout something on this issue.

Feel free to ask if you've further queries.
