Interspousal Transfer Deed signed during legal separation

Posted on: 25th Sep, 2007 03:08 pm
In January I started filing for legal separation from my husband. In February we sold our house and he signed an interspousal transfer deed. The escrow company then gave me a check solely in my name. I gave him $100,000 from the profits of the home, all the furniture, dishes, etc, and paid off his debts for him. Now he has started divorce proceedings and is threatening to come after me for more money from the sale of the house. Does he have any claim to that money? I have since used that money to buy my own residence and am worried he might have some claim on my new residence. My new residence is in my name and my brother's name. Thank you for any information you can provide.
Hi Redeemed,

Welcome to the froum.

By signing over the interspousal deed, your husband has already given up his rights to the property and has handed over the property solely in your name. As such he can no longer retain the ownership rights.

Now, he does not have any right to claim the money that you receive from the sale proceeds.
