Joint Mortgage!

Posted on: 16th Oct, 2009 11:42 am
hello,

i have a joint mortgage with my ex- fiancee (deed and loan). we decided not to get married so i moved out from the house. my fiancee got approved to refinance the mortgage and she asked me to sign the paperworks to remove my name from the deed and the loan. i refused to do so and request a sum of money for what i spent in the house. my fiancee refused to give me any thing (we have around $40k in equity) and told me she is going to take me to court to force me to take my name from both the deed and the loan. can she do that even if i own half of the house and i have the signed paperworks and every thing?

thanks!
Nope she cannot do that legally

You legally have 50% wonership in the property

make sure keep all the records in place ( Down payment details any monthly paymnets you have doen on the loan etc)
