Joint Tenancy with Survivorship

In 1991 I bought a house while in the military and did a simple assumption to my parents with the understanding I would stay on the Title and Deed. My name was left off and my mom inquired before they signed the papers, and we decided to add me later. My father died in May 08 and my mom added me on a Joint Tenancy in Sep 08 to keep my siblings from trying to take it from me. Now she is mad at me and had me served with a quitclaim to sign to remove my name by 30 Oct 09. I own practically all of the furniture and household items, and did some decorating in Oct 08. What is my rights?

Hi LJ,

As your name is on the property deed now, you would be considered as one of the owners of the property. She won't be able to force you to transfer the property to her. It is your discretion whether or not you would transfer the property to her. If she forces you for a property transfer, that would be considered as illegal and you can take legal steps against her.

There's nothing your Mother can do to force you to sign the Quit Claim. She has no legal right. It'd be like you telling her she has to Quit Claim her name off the Deed. Why would she do that? Why would you do it? It doesn't make sense.
