Joint tenant that holds mortgage has passed away.

My husband and I are joint tenants on the deed with his mother. His mother was the only one on the mortgage.

She passed away and the house is currently in foreclosure. Is the mortgage automatically transferred to us? Is there anything we can do to save the house?

hi sabrespa,

the mortgage is not automatically transferred to you. if you refinance the loan in your name, then you would be liable for the mortgage dues. if you want to save the property, then you'll have to make the mortgage payments on time.
