Judgements and property leins

Posted on: 12th Feb, 2009 10:24 am
Here is my problem. I live in Florida and own 1 acre of land that I live on with my minor children. I also own 1.5 acres next door that my mother lives on in a mobile home with my handicapped brother. If a judgement is placed against me can they make my mother move off of the property so that it can be sold to pay off the judgement? I don't have title to either properties because I am still making payments on both. Thank you.
Hi Rsmy,

If both the properties are in your name, then a judgment can be placed on any of the properties. But if the other property is in your mother's name, then I don't think a judgment can be placed on that property. In that case, once the judgment is passed, lien will be placed on the property which you own.

Thanks

Hi Rsmy,

Since you've mentioned you don't have title to either properties, I don't think you've any reason to think that a judgement could be placed on them. As jameshogg had mentioned, if any judgement is passed, lien would be placed on only that property the title of which is in your name.
