When my father became I'll I had durable power of attorney. I consulted an attorney and had a lady bird deed drawn up in my name. Currently I'm in the process in selling the house (in Florida ), I'm unable to get title insurance. Underwriters state that since I had the POA, I'm not aloud to. Help
Hi Kerry,
If your name is mentioned in the ladybird deed as one of the owners of the property, then I don't think you should face any problems in getting the title insurance. I will suggest you to contact your other local insurance companies and check out if they can help you in this regard.
Thanks

The transaction could be amended by a reconveyance of the property from the grantee back to the original owner. The deed could then be executed again with the desired changes. However, the transaction should be handled by an attorney who specializes in real estate and is familiar with your state laws.
