My father is diabled and has been for some time, due to a work site incident. He has had his legs both removed due to diadetes, infection etc. My lawyer advised us to place his land and home intoa Lady Bird Deed, so as to avoid Medicaid problems if we were to ever have to put him in a nursing home. He is 69 and has been recieving Medicaid for some time. Would he have any problems being denied Medicaid after we get a Ladybird Deed. His land and home value are approximately 129,000.

A property transfer now can make him ineligible for Medicaid benefits for the next 5 years as they have a look back period of 5 years. However, if a ladybird deed is valid in your state, then your father can use it to transfer the property to someone else. In that case, his Medicaid eligibility will not be affected.
