When we refied my wifes credit prevented her from being on the mortgage, my credit was much better and we got a low rate. Now she is afraid that if I pass the home will go to my two kids, previous marriage, and she'll be left with nothing. She wants to be added but the lawyer says the bank will not recognize the conveyance without her being on the mortgage.

Welcome to the forum. You can add your wife on the title by using a quitclaim deed but you need to take confirmation from the lender before adding your wife on the deed. BTW where do you live? If this is a community property state then she will have 50 percent of the ownership even without adding her on the deed.

Thank you larry, we live in Connetcicut which, as I've checked, is not a community P S. Providing the lender will allow confirmation would she then have a 50% interest? All she is asking for is "rights" to the amount she contributed on a percentage bases of net proceeds after all debt has been paid. I'm thinking a simly contract drawn up by our attonery will work?

it is true that your lender would likely not approve of your transfer of title, but unless you are in default or end up in default on that mortgage, the risk of their taking any sort of action is nil. by all means, consult with your legal counsel to determine how best to structure your ownership with your wife.
generally, adding a spouse to the title of a home would grant her every right that you currently have; but for genuine legal advice, always rely on your attorney.

the property is paid for I want to transfer the titel to her name and later she can resale if somthing happen to me.

If the property is paid for, then it's quite easy to transfer the title. You may fill out a quitclaim deed and convey your interest in property to your spouse. Take a look at some of the sample quitclaim forms (for different states) available in this community.
