What papers do I file if the grantor is dead?

My father is deceased and me and my brother found some land in his name what papers do we need to file to get the land in our names or to be able to claim the land in our names?

It seems that your father has not left any will that clearly states how the property should be divided among you and your brother. Am I right? If this is what the case is, you need to file an affidavit of heirship with the probate court. The court will then decide how the property will be distributed among you two brother according to the laws of intestacy as applicable in your state. Once the property has been divided, you can change the title in your name.
