My grandfather passed away several years ago and he left my aunt as the executive of his will, she has done nothing. In his will he had land that was to be divided and given to all his 5 children, and that if the children are deceased it is to go to their children, I am an only child. I have been trying to get the land that was to be my moms but have had no luck, can you please tell me what I can do to get the land that was to be my mom's into my name? before the land is sold for the clean up fees by the city or something. Also, another aunt wants to give me her land she is to get from the will, how can I get this land in my name also? Thanks for any help you can give me on this matter.
Hi soldiers_mom,
As there is a will, it needs to be probated first. You should contact an attorney and get the will probated. Once the probate is complete, the property would be divided accordingly as mentioned in the will. As far as your aunt's share of property is concerned, she can sign a quitclaim deed and transfer the property in your name.
Thanks.
